LAWS OF MARYLAND
BY repealing and reenacting, with amendments, Article 2B - Alcoholic Beverages Section Sections 6(b), 25(1) and 45(d-1) Annotated Code of Maryland (1976 Replacement Volume and 1976 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section Sections 6(b), 25(1) and 45(d-1)
of Article 2B - Alcoholic Beverages, of the Annotated
Code of Maryland (1976 Replacement Volume and 1976
Supplement) be and it is they are hereby repealed and
reenacted, with amendments, to read as follows: Article 2B - Alcoholic Beverages 6. (b) (1) A wholesaler's license in accordance
with the fee paid shall entitle the holder to acquire the
alcoholic beverages indicated thereon, from licensees and
holders of nonresident dealer's permits authorized by
this State to make such sales and deliveries. Such a
license shall authorize the sale and delivery of such
alcoholic beverages from the licensed premises to
licensees and permit holders in Maryland and persons
outside of this State. A wholesale license of Class 5
and Class 6 when issued shall designate the counties
and/or Baltimore City in which the licensee is privileged
to sell and such licensee shall sell beer only to retail licensees located in such designated counties and/or Baltimore City. (2) IN ALLEGANY COUNTY THE HOLDER OF A CLASS
1 OR CLASS 2 WHOLESALER'S LICENSE MAY NOT SELL LIQUOR IN
ANY SIZE CONTAINER SMALLER THAN 4/5 QUART TO ANY HOLDER
OF A SPECIAL PERMIT ISSUED UNDER SECTION 25(L) OF THIS
ARTICLE. (1) In Allegany County, the board of license
commissioners may issue a special permit to holders of Class D beer and Class D beer and light wine licenses, that allows the sale of beer, wine and liquor by the
drink for consumption on the premises. A holder of this
special permit may continue to sell beer or beer and wine
for consumption on or off the premises, but he [shall]
MAY not (1) sell liquor for, consumption off the premises,
OR (2) PURCHASE OR POSSESS LIQUOR ON THE PREMISES IN ANY
SIZE CONTAINER SMALLER THAN 4/5 QUART. Application for this special permit shall be made not less than 30 days prior to the day on which the permit is to take effect.
The annual fee for this special permit is $500.00.
