SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 369 (a) of Article 41 - Governor -
Executive and Administrative Departments, of the
Annotated Code of Maryland (1971 Replacement Volume and
1976 Supplement) be and it is hereby repealed and
reenacted, with amendments, to read as follows:

(a) [The] SUBJECT TO THE PROVISIONS OF SECTION
369A, THE Commission has the powers and duties listed in
this section and elsewhere in this subtitle or delegated
to it by the Secretary of Economic and Community
Development.

SECTION 2. AND BE IT FURTHER ENACTED, That new
Section 369A be and it is hereby added to Article 41 —
Governor - Executive and Administrative Departments, of
the Annotated Code of Maryland (1971 Replacement Volume
and 1976 Supplement) to read as follows:
Article 41 — Governor - Executive and Administrative
Departments
369A.
(A) (1) IN THIS SECTION, THE FOLLOWING WORDS
HAVE THE MEANINGS INDICATED.
(2) "DWELLING" MEANS THE DWELLING HOUSE OF
ONE OR MORE HOMEOWNERS, AND THE CURTILAGE WHERE IT IS
ERECTED, WHICH IS USED AS THE PRINCIPAL RESIDENCE OF THAT
HOMEOWNER OR HOMEOWNERS.
(3) "HOMEOWNER" MEANS A PERSON WHO, ON JULY
1, 1976, ACTUALLY RESIDES IN A DWELLING IN WHICH THAT
PERSON HAS A LEGAL INTEREST, INCLUDING ANY LIFE ESTATE,
WHETHER AS SOLE OWNER, JOINT TENANT, TENANT IN COMMON OR
TENANT BY THE ENTIRETY.
