(d) The Department shall hold a hearing in each
county where an interim flood hazard area lies. The
Department shall publish notice of each hearing in a
newspaper of general circulation within the appropriate
subdivision, and where the interim flood hazard area
lies. After holding a public hearing in each county
where an interim flood hazard area lies, the Department
shall adopt each map as a rule or regulation [by August
1, 1977.] WITHIN SIX MONTHS OF THE DATE OF HEARING.
(e) After adopting any interim flood hazard area
map, the Department may conspicuously mark in the field
(1) the location of the flood hazard area; and (2) other
areas the Department may deem necessary to effectuate the
purposes of this subtitle.
8-9A04.
(a) [By November 1, 1978, every] WITHIN ONE YEAR
AFTER ADOPTION OF A MAP AS A REGULATION OF THE
DEPARTMENT, THE subdivision shall adopt rules and
regulations for governing uses within interim flood
hazard areas upon consideration of the following:
(1) The availability of alternate locations
for the use;
(2) The permanency of the use;
(3) The effect of the use en planned
development of the area adjacent to it;
(4) Whether the area is an area of tidal or
nontidal inundation;
(5) Good husbandry practices common to normal
and efficient agricultural production;
(6) Any other factor consistent with the
purposes of this subtitle.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall rake effect July 1, 1977.
