(3) "RESTAURANT" MEANS EVERY FACILITY
THAT PREPARES FOOD AND PROVIDES SEATING CAPACITY FOR
PATRONS.
(4) (3) "SECRETARY" MEANS THE SECRETARY OF
THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE.
(B) THE SECRETARY OF THE DEPARTMENT OF HEALTH AND
MENTAL HYGIENE SHALL IMPLEMENT A PROGRAM TO INSTRUCT
RESTAURANT OPERATORS IN THE USE OF THE HEIMLICH MANEUVER
FOR REMOVING FOOD LODGED IN THE THROAT OF AN INDIVIDUAL.
(C) EVERY RESTAURANT OPERATOR SHALL POST AND
MAINTAIN IN A CONSPICUOUS PLACE IN THE EVERY RESTAURANT A
DIAGRAM GIVING CLEAR AND ILLUSTRATIVE DIRECTIONS ON THE
USE OF THE HEIMLICH MANEUVER MANUAL MANEUVERS TO ASSIST
CHOKING VICTIMS.
(D) A RESTAURANT OPERATOR SHALL COMPLETE A COURSE
OF INSTRUCTION APPROVED BY THE DEPARTMENT OF HEALTH AND
MENTAL HYGIENE IN UTILIZING THE HEIMLICH MANEUVER. UPON
COMPLETION OF THE COURSE, THE RESTAURANT OPERATOR WITHIN
A REASONABLE TIME SHALL TRAIN ALL EMPLOYEES IN THE
METHOD.
(E) (C) A PERSON WHO APPLIES THE HEIMLICH
MANEUVER THESE MANEUVERS TO REMOVE FOOD LODGED IN THE
THROAT OF ANOTHER IS LIABLE ONLY IF HIS ACTIONS AMOUNT TO
GROSS NEGLIGENCE.
(F) A RESTAURANT OPERATOR WHO VIOLATES THE
PROVISIONS OF THIS SECTION IS GUILTY OF A MISDEMEANOR AND
UPON CONVICTION IS SUBJECT TO A FINE NOT EXCEEDING $50.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977.
