AN ACT concerning
Flammable Articles - Regulation
FOR the purpose of directing the Department of Health and
Mental Hygiene to adopt certain federal standards
concerning flammable products; establishing certain
exceptions; specifying the manner in which the
Department may make certain inspections of certain
establishments and may embargo certain products;
requiring the Department to make certain findings
and provide certain information to the public; and
generally relating to the regulation of flammable
products.

Section 892 through 896 897, inclusive, to be under
the new subtitle "Maryland Flammable

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Sections 892 through 896 897,
inclusive, to be under the new subtitle "Maryland
Flammable Articles Act" be and they are hereby added to
Article 43 — Health, of the Annotated Code of Maryland
(1971 Replacement Volume and 1976 Supplement) to read as
follows:
Article 43 - Health
MARYLAND FLAMMABLE ARTICLES ACT
892.
(A) THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE
SHALL ADOPT THE FEDERAL STANDARDS FOR FLAMMABLE FABRICS
ESTABLISHED UNDER THE FEDERAL FLAMMABLE FABRICS ACT,
PUBLIC LAW 90-189.
(B) AS A CONSEQUENCE OF ENGAGING IN ANY COMMERCIAL
ENTERPRISE, A PERSON MAY NOT MANUFACTURE, HOLD WITH THE
INTENT TO SELL, SELL, OR GIVE AWAY OR SELL ANY NEW OR
UNUSED ARTICLE OF CLOTHING, SLEEPWEAR, MATTRESS, OR
MATTRESS PAD THAT DOES NOT CONFORM TO THE STANDARDS
ADOPTED UNDER THIS SECTION.
