FOR the purpose of excepting bicycles from using bikeways
under certain circumstances; defining a certain
term; requiring the Motor Vehicle Administration to limiting the current requirement that a bicyclist shall use a bicycle path or paved shoulder; listing situations when the limiting requirement is inapplicable; defining certain terms; requiring the Department of Transportation to promulgate certain
rules and regulations; clarifying language; and
generally relating to the operation of bicycles and
other vehicles on roadways. BY adding Article - Transportation
Sections 21-101 (1-1), (1-2), and (j-3)
Annotated Code of Maryland (As enacted by Chapter 14 of the Acts of the
General Assembly of 1977) BY repealing and reenacting, with amendments, Article - Transportation Sections 21-309(b), 21-604 (a)(2), and 21-1205.1(b) Annotated Code of Maryland (As enacted by Chapter 14 of the Acts of the General Assembly of 1977) SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, That Sections 21-101 (j-1), (j-2), and (j-3) of Article — Transportation, of the Annotated Code of Maryland (As enacted by Chapter 14 of the Acts of the General Assembly of 1977) be and they are hereby added to
read as follows: Article - Transportation 21-101. (J-1) "BIKEWAY" MEANS ANY TRAIL, PATH, SIDEWALK, PART OF THE ROADWAY OR SHOULDER, OR ANY OTHER TRAVELWAY SO DESIGNATED BY SIGNING, OR SIGNING AND MARKING FOR THE USE OF BICYCLES. A BIKEWAY INCLUDES A BIKE LANE. (J-2) "BIKE LANE" MEANS A PORTION OF A ROADWAY WHICH HAS BEEN DESIGNATED FOR PREFERENTIAL OR EXCLUSIVE USE BY BICYCLES. IT IS DISTINGUISHED FROM THE PORTION OF THE ROADWAY FOR MOTOR VEHICULAR TRAFFIC BY A PAINT STRIPE, CURB OR OTHER SIMILAR DEVICE. (J-3) "SHOULDER" MEANS THAT PORTION OF A HIGHWAY CONTIGUOUS WITH THE ROADWAY FOR THE ACCOMODATION OF STOPPED VEHICLES, FOR EMERGENCY USE, AND FOR THE LATERAL SUPPORT OF THE BASE AND SURFACE COURSE OF THE ROADWAY. SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND 2. AND BE IT FURTHER ENACTED, That Sections 21-309(b), 21-604(a)(2), and 21-1205.1(b) of Article -
