SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 68(a) of Article 77 - Public
Education, of the Annotated Code of Maryland (1975
Replacement Volume and 1976 Supplement) be and it is
hereby repealed and reenacted, with amendments, to read
as follows;
Article 77 — Public Education
68.
(a) The county superintendent of schools, acting
under the rules and regulations of the county board of
education, is responsible for the administration of the
office of the county superintendent of schools. He shall
nominate, for appointment by the county board of
education, all the professional assistants of the office
and may recommend their removal for immorality,
misconduct in office, incompetency, insubordination, or
wilful neglect of duty, and he shall see that all regular
appointees of the county board of education devote their
entire time to their duties. The county superintendent
of schools shall appoint clerical and other
nonprofessional personnel, EXCEPT THAT IN WORCESTER
COUNTY, THE COUNTY SUPERINTENDENT OF SCHOOLS SHALL
APPOINT CLERICAL AND OTHER NONPROFESSIONAL PERSONNEL
WITH THE ADVICE AND CONSENT OF THE COUNTY BOARD OF
EDUCATION. However, the qualification of all appointees
and their tenure and compensation, subject to the
provisions of this article, shall be determined by the
county board of education. In Baltimore City, the
appointment, tenure, and compensation of clerical and
other nonprofessional personnel shall be determined in
accordance with the Baltimore City charter.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977.
