and pay SEMIANNUALLY to each incorporated town MUNICIPAL
CORPORATION in the county a ONE HALF share of those funds
in the ratio which the population of each such town
MUNICIPAL CORPORATION (figured on the test and most
reliable figures available in the opinion of the county
commissions) bears to the total population of the county.
However, the distribution shall be made only if the two
following conditions are met:
(i) The funds are used for the
construction or maintenance of streets, or sewerage
facilities or water systems, or garbage collections and
disposal within the town MUNICIPAL, CORPORATION; and
(ii) The town MUNICIPAL CORPORATION
raises by taxation and applies for the same purpose as
are the distributed funds an amount equal to any funds so
distributed. The share which any incorporated town
MUNICIPAL CORPORATION failing to comply with the
provisions of this section would have received upon such
compliance shall be [retained by] DISTRIBUTED TO the
county.
(2) In Prince George's County (the county
commissioners] and in Montgomery County the [county
executive] COMPTROLLER shall use in determining the
distribution to cities and towns MUNICIPAL CORPORATIONS
the most recent population figures of the county and the
cities and towns which are published by the
Maryland—National Capital Park and Planning Commission,
provided that the figures published by the Commission are
more recent than the latest federal decennial census or
other countywide census.
(3) AS OFTEN AS PRACTICABLE, BUT NOT LESS
FREQUENTLY THAN SEMIANNUALLY, THE COMPTROLLER SHALL PAY
OVER AND DISTRIBUTE TO THE COUNTIES, BALTIMORE CITY, AND
THE MUNICIPAL CORPORATIONS THE RESPECTIVE AMOUNTS TO
WHICH THEY ARE ENTITLED UNDER THE PROVISIONS OF THIS
SECTION.
(C) Any funds allocated and paid to any county of
the State under the provisions of this section[, which
shall not be distributed to incorporated towns in the
county as hereinabove provided,] shall be used by the
county only for the construction and maintenance of
capital assets, including roads, schools, water system,
electric light and power systems, gas systems, bridges
and grade crossing elimination.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977.
