SUBTITLE 9. LICENSING OF AIR SCHOOLS.
5-901. "AIR SCHOOL" DEFINED.
IN THIS SUBTITLE: (1)   "AIR SCHOOL" MEANS, EXCEPT AS PROVIDED IS
ITEM (2) OF THIS SECTION, ANY PERSON WHO, WHETHER OR NOT
FOR COMPENSATION, GIVES OR OFFERS TO GIVE INSTRUCTION IN
FLYING OR IN GROUND SUBJECTS RELATING TO AERONAUTICS; AND (2)   "AIR SCHOOL" DOES NOT INCLUDE: (I)   ANY PUBLIC SCHOOL OR OTHER NON-COLLEGIATE
NONCOLLEGIATE EDUCATIONAL INSTITUTION APPROVED BY THE
STATE BOARD OF EDUCATION UNDER ART. 77 OF THE CODE; OR (II)     ANY COLLEGE, UNIVERSITY, OR OTHER
INSTITUTION OF POST SECONDARY EDUCATION APPROVED BY THE
STATE BOARD FOR HIGHER EDUCATION UNDER ART. 77A OF THE CODE. REVISOR'S NOTE: This section is new language that
effectively combines Art. 1A, §§1—104 and
1-111. It is placed in this subtitle since
the defined term "air school" appears only in
and applies only to this subtitle. Item (2) is rewritten for clarity to conform
to the nomenclature and jurisdictional changes
adopted by Chs. 538 and 539, Acts of 1976.
Although the present reference to a "public
school" might be read literally to exclude,
for example, an approved private high school
— cf. Art. 77, §1 as to use of the term
"public school" — there appears to be no
reason to distinguish between a public school
and any other approved "non—collegiate
educational institutions". As to
non—collegiate educational institutions,
generally, see Art. 77, §11 of the Code; as to
institutions of post secondary education,
generally, see Art. 77A, §32A of the Code. The present, separate definition for and all
present references in the source law to an
"aeronautics instructor" are deleted as
