(B) VARIANCES.
THE BOARD OF AIRPORT ZONING APPEALS MAY GRANT
VARIANCES FOR STATE OWNED AIRPORTS IN THE MANNER SET
FORTH IN §5-815 OF THIS SUBTITLE.
(C) JUDICIAL REVIEW.
ANY AGGRIEVED PERSON OR ANY OFFICER OR AGENCY OF
AN AFFECTED POLITICAL SUBDIVISION MAY APPEAL FROM A
DECISION OF THE BOARD OF AIRPORT ZONING APPEALS IN THE
MANNER SET FORTH IN §5-816 OF THIS SUBTITLE.
REVISOR'S NOTE: This section presently appears as
Art. 1A, §7-703(h)(2) and (3).
In subsection (a) of this section, a
cross-reference to §5-814 of this subtitle is
added for clarity, and the subsection revised
to delete the limitation of permitting appeals
only from the "denial" of a permit. As
revised, this conforms to similar provisions
elsewhere in this title, which implicitly
recognize that the Administration might
erroneously grant a permit in a manner
justifying a right of appeal to the board.
The only other changes ace in style.
As to the Board of Airport Zoning Appeals,
generally, see Subtitle 5 of this title.
5-823. ACQUISITION AND DISPOSITION OF PROPERTY.
(A) ACQUISITION.
THE ADMINISTRATOR MAY ACQUIRE, BY PURCHASE OR
CONDEMNATION, ANY PROPERTY FOR NOISE COMPATIBILITY
PURPOSES IN ANY NOISE ZONE SURROUNDING A STATE OWNED
AIRPORT.
(B) DISPOSITION.
ANY PROPERTY ACQUIRED UNDER SUBSECTION (A) OF THIS
SECTION MAY BE RESOLD, WITH OR WITHOUT DEED RESTRICTIONS,
OR LEASED, WHOLLY OR PARTLY. HOWEVER, IF THE DISPOSITION
OF AN INTEREST IN REAL PROPERTY IS FOR A NONAIRPORT
RELATED USE, IT SHALL BE MADE IN ACCORDANCE WITH PLANS
OF THE POLITICAL SUBDIVISION IN WHICH THE PROPERTY IS
LOCATED.
