MARVIN MANDEL, Governor                              2255 SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 4-904 and 4-905 of Article -
Natural Resources, or the Annotated Code of Maryland
(1974 Volume and 1976 Supplement) be and they are hereby repealed: Article - Natural Resources [4-904. A person in charge of any boat or vessel rigged for
catching surf clams shall obtain a license from the
Department before he catches any surf clams in the waters
of the State. The license is valid for the year in which
it is issued. The fee to issue and renew the license is
$5. A nonresident of the State may not obtain a license
to catch surf claims.] [4-905. The Department shall adopt rules and regulations
governing the catching and landing of surf clams,
especially taking into consideration the recommendations
of regional management plans developed in cooperation
with neighboring coastal states and the U. S.
Department of Commerce. Any rules or regulations adopted
pursuant to this section shall only be effective until
July 1, 1977.] SECTION 2. AND BE IT FURTHER ENACTED, That
"Subtitle 9. Lobster, Terrapin, and Surf Clams." of
Article — Natural Resources of the Annotated Code of
Maryland (1974 Volume and 1976 Supplement) be and it is
hereby renamed to be "Subtitle 9. Lobster and Terrapin." SECTION 3. AND BE IT FURTHER ENACTED, That new
Sections 4-1041 through 4-1043, inclusive, to be under
the new subheading, "Part V. Surf Clams and Ocean
Quahogs." be and they are hereby added to Article —
Natural Resources, of the Annotated Code of Maryland
(1974 Volume and 1976 Supplement) to read as follows: Article - Natural Resources PART V. SURF CLAMS AND OCEAN QUAHOGS. 4-1041. (A)    A PERSON IN CHARGE OF ANY BOAT OR VESSEL
RIGGED FOR CATCHING SURF CLAMS OF OCEAN QUAHOGS SHALL
DETAIN A LICENSE FROM THE DEPARTMENT BEFORE HE CATCHES
ANY SURF CLAMS IN THE WATERS OF THE STATE OR LANDS ANY
SURF CLAMS OF OCEAN QUAHOGS IN THE STATE. THE LICENSE IS
VALID FOR THE YEAR IN WHICH IT IS ISSUED. THE FEE TO
ISSUE AND RENEW THE LICENSE IS $5. (B)    A NONRESIDENT OF THE STATE MAY NOT OBTAIN A
LICENSE TO CATCH SURF CLAMS. HOWEVER, A NONRESIDENT MAY
OBTAIN A LICENSE TO LAND SURF CLAMS OF OCEAN QUAHOGS IN THE STATE. THE FEE FOR THIS LICENSE IS $25.
