enable accredited schools of pharmacy to experiment with
new and innovative methods for drug handling, teaching,
and research and to develop new and better methods or
concepts involving the practice of pharmacy, the Board of
Pharmacy should have the authority to waive certain
requirements currently contained in the laws relating to
the practice of pharmacy; now, therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 268A be and it is hereby added
to Article 43 - Health, of the Annotated Code of Maryland
(1971 Replacement Volume and 1.976 Supplement) to read as
follows:
Article 43 - Health
268A.
(A) THE BOARD MAY WAIVE THE REQUIREMENTS OF
SECTIONS SECTION 268(A) AND (B) FOR ANY ACCREDITED SCHOOL
OF PHARMACY RECOGNIZED BY THE BOARD IF:
(1) THE DEAN OF THE SCHOOL HAS FILED WITH
THE BOARD AN EXPERIMENTAL PLAN OR TEACHING PROGRAM. THE
PLAN OR PROGRAM SHALL SPECIFY THE PARTICULAR REQUIREMENTS
OF SECTIONS 268(B)(A) THROUGH (B)(C) WHICH THE SCHOOL
DESIRES THE BOARD TO WAIVE; AND
(2) THE PLAN OR PROGRAM FILED BY THE SCHOOL
HAS BEEN APPROVED BY THE BOARD. THE BOARD MAY NOT
APPROVE ANY EXPERIMENTAL PLAN OR PROGRAM UNLESS THE BOARD
HAS DETERMINED THAT THE PLAN OF PROGRAM WILL NOT
JEOPARDIZE THE PUBLIC HEALTH AND WELFARE.
(B) IF AT ANY TIME THE BOARD DEEMS THAT THE PUBLIC
HEALTH, WELFARE, AND INTEREST IS NOT BEING FULLY
PROTECTED UNDER ANY APPROVED PLAN OR PROGRAM, THE BOARD
MAY RESCIND ITS APPROVAL AND ORDER TERMINATION OF THE
PLAN OR PROGRAM.
(C) THE BOARD SHALL ADOPT RULES AND REGULATIONS
NECESSARY TO CARRY OUT THE PROVISIONS OF THIS SECTION,
INCLUDING THE PROCEDURES AND CRITERIA REQUIRED FOR
APPROVAL OF A PLAN OR PROGRAM UNDER THIS SECTION AND THE
PROCEDURES TO BE FOLLOWED BY THE BOARD WHEN IT DESIRES TO
RESCIND APPROVAL AND TERMINATE A PLAN OR PROGRAM THE
UNIVERSITY OF MARYLAND SCHOOL OF PHARMACY, FOR RADIO
PHARMACY AND DENTAL PHARMACY EXPERIMENTAL AND TEACHING
PROGRAMS.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977.
