VIOLATION CONTINUES.
REVISOR'S NOTE: This section presently appears as
Art. 1A, §§8-801(f) and 8-802(i).
Although the $500—penalty provided for in
present §8-802(i) is unqualified, its
provisions are inconsistent with those of
present §8—801(f), which permit the political
subdivision itself to establish the
appropriate punishment. To rectify this
anomoly, subsection (b) of this section is
revised to condition the $500-fine on the
failure of the political subdivision to set
its own penalty. The minimum penalty of $25
presently provided for in §8-802(i) is
deleted; in this regard, see revisor's note to
§5-511 of this title.

5-701. LEGISLATIVE POLICY.
(A) DANGERS OF OBSTRUCTIONS.
AN OBSTRUCTION TO AIR NAVIGATION:
(1) INTERFERES WITH THE PUBLIC RIGHT OF
FREEDOM OF TRANSIT IN AIR COMMERCE;
(2) ENDANGERS THE LIVES AND PROPERTY OF THOSE
USING THE AIRSPACE FOR TRANSPORTATION; AND
(3) ENDANGERS THE LIVES AND PROPERTY OF THE
OCCUPANTS OF LAND IN THIS STATE.
(B) REGULATION REQUIRED.
THE PUBLIC HEALTH, SAFETY, AND WELFARE REQUIRE
REGULATION OF THE ERECTION AND MAINTENANCE OF
OBSTRUCTIONS TO AIR NAVIGATION.
