SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 16A be and it is hereby added
to Article 88A — Social Services Administration, of the
Annotated Code of Maryland (1969 Replacement Volume and
1976 Supplement) to read as follows:

|
THE STATE SOCIAL SERVICE ADMINISTRATION SHALL MAKE
EVERY EFFORT TO RECOUP THOSE OVERPAYMENTS MADE TO
RECIPIENTS WHICH THE STATE IS PERMITTED TO RECOUP UNDER
APPLICABLE FEDERAL LAW, RULES, REGULATIONS, OR
GUIDELINES. BY OCTOBER 1, 1977, THE STATE ADMINISTRATION
SHALL ESTABLISH AN ADMINISTRATIVE PROCEDURE, ACCORDING TO
APPLICABLE FEDERAL LAW, RULES, REGULATIONS, OR
GUIDELINES, TO BE FOLLOWED IN THOSE CASES IN WHICH THE
ADMINISTRATION HAS REASON TO BELIEVE THAT AN OVERPAYMENT
HAS BEEN MADE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall be construed only prospectively and may not be
applied or interpreted to have any effect upon or
application to any payments made to recipients prior to
the effective date of this Act.

|
|
|
|
|
|
|
SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977.
