2106                                    LAWS OF MARYLAND                           Ch. 357
AN ACT concerning Reserved Parking For Disabled Persons FOR the purpose of providing that the Motor Vehicle
Administration may issue a permit for a reserved
parking space to a person who has a permanent
physical disability under certain conditions, even
though the applicant is not required to use a
wheelchair; defining when a disability is permanent;
and restructuring, BY repealing and reenacting, with amendments, Article - Transportation Section 21-1005 Annotated Code of Maryland (As enacted by Chapter____of the Acts of the General Assembly of 1977)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 21-1005 of Article
Transportation, of the Annotated Code of Maryland (As enacted by Chapter____of the Acts of the General Assembly of 1977) be and it is hereby repealed and reenacted, with
amendments, to read as follows: Article — Transportation 21-1005. (A)          FOR PURPOSES OF THIS SECTION, A PHYSICAL DISABILITY IS PERMANENT IF IT IS EXPECTED TO CONTINUE FOR AT LEAST ONE YEAR. [(a)](B)(A) [If, because of] A PERSON WHO HAS a
permanent physical disability[, a person is required to
use a wheelchair to move about, the person] may apply to
the Administration, on the form that it requires, for a
permit for one reserved parking space: (1)         To be located at the curb, side, or edge
of the roadway of the highway in front of or near his
dwelling house; and (2)         To provide convenience and safety as the
person enters or leaves his vehicle or that of another. (C) (B)               THE ADMINISTRATION SHALL ISSUE THE PERMIT: (1) IF THE APPLICANT IS REQUIRED TO USE A
WHEELCHAIR TO MOVE ABOUT OR IF THE ADMINISTRATION
DETERMINES THAT THE DISABILITY IS SO SEVERE THAT THE
APPLICANT WOULD ENDURE A HARDSHIP OF BE SUBJECT TO A RISK
OF INJURY IF THE APPLICANT SHOULD ENTER OR LEAVE THE
