SECTION 2. AND BE IT FURTHER ENACTED, That new
Section 266A(g) be and it is hereby added to Article 41 —
Governor — Executive and Administrative Departments, of
the Annotated Code of Maryland (1971 Replacement Volume
and 1976 Supplement) to read as follows:

Administrative Departments
266A.
(G) THE TERM "SOLID WASTE DISPOSAL FACILITIES"
MEANS ANY PROPERTY OR PORTION THEREOF USED FOR THE
COLLECTION, STORAGE, TREATMENT, UTILIZATION, PROCESSING,
OR FINAL DISPOSAL OF SOLID WASTES. THE TERM INCLUDES BUT
SHALL NOT BE LIMITED TO SOLID WASTE DISPOSAL FACILITIES
WHICH CAN BE FINANCED BY BONDS DETERMINED TO BE TAX
EXEMPT UNDER THE PROVISIONS OF THE INTERNAL REVENUE CODE
OF 1954. SOLID WASTE DISPOSAL FACILITIES MAY BE
CONSTRUCTED AS PART OF, AND MAY INCLUDE, FACILITIES ALSO
DESIGNED FOR THE RECOVERY OF MATERIALS OR ENERGY FROM
THE SOLID WASTE OR TO SERVE SOME OTHER PURPOSE, BUT WHICH
ALSO CONTRIBUTE TO THE COLLECTION, STORAGE, TREATMENT,
UTILIZATION, PROCESSING, OR FINAL DISPOSAL OF SOLID
WASTES.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977.
