AN ACT concerning
Pine Tree Reforestation
FOR the purpose of requiring certain trees to be reserved
or reforested upon completion of certain commercial
cutting operations; requiring the submission of
certain pine tree reservation or reservation of pine
trees or the submission of reforestation plans to
the Department of Natural Resources; authorizing the
Department to administer the subtitle including
approval of pine tree reservation or reforestation
plans; providing for enforcement through injunctive
relief; defining certain terms; establishing certain
penalties; and generally relating to pine tree
reforestation.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Sections 5-501 through 5-509 to be
under the new subtitle "Subtitle 5. Pine Tree
Reforestation" be and they are hereby added to Article —
Natural Resources, of the Annotated Code of Maryland
(1974 Volume and 1976 Supplement) to read as follows:
Article - Natural Resources
SUBTITLE 5. PINE TREE REFORESTATION
5-501.
(A) IN THIS SUBTITLE THE FOLLOWING TERMS HAVE THE
MEANINGS INDICATED.
(B) "CUTTING OPERATION" MEANS THE CUTTING OF
TIMBER FOR COMMERCIAL PURPOSES FROM ONE ACRE FIVE ACRES
OR MORE OF LAND ON WHICH LOBLOLLY PINE (PINUS TAEDA),
SHORTLEAF PINE (PINUS ECHINATA), OR POND PINE (PINUS
SEROTINA), SINGLY OR TOGETHER OCCUR AND CONSTITUTE 10 25
PERCENT OR MORE OF THE LIVE TREES ON EACH ACRE.
(C) "DIAMETER" MEANS THE DISTANCE THROUGH THE TREE
AT THE POINT OF AVERAGE THICKNESS AS MEASURED FROM
OUTSIDE THE BARK TO OUTSIDE OF BARK AT A POINT ON THE
