5-608. SAME - ZONING COMMISSION.
(A) APPOINTMENT OF AIRPORT ZONING COMMISSION.
(1) FOR PURPOSES OF THIS SUBTITLE, THE
LEGISLATIVE BODY OF THE POLITICAL SUBDIVISION SHALL
APPOINT AN AIRPORT ZONING COMMISSION TO RECOMMEND THE
BOUNDARIES OF THE VARIOUS ORIGINAL DISTRICTS AND
APPROPRIATE REGULATIONS TO BE ENFORCED.
(2) A ZONING BOARD OF APPEALS OF THE
POLITICAL SUBDIVISION MAY BE DESIGNATED AS THE AIRPORT
ZONING COMMISSION.
(B) REPORTS OF COMMISSION REQUIRED.
THE COMMISSION SHALL MAKE A PRELIMINARY REPORT AND
HOLD A PUBLIC HEARING ON IT BEFORE SUBMITTING ITS FINAL
REPORT. THE LEGISLATIVE BODY MAY NOT HOLD ITS PUBLIC
HEARINGS OR TAKE ANY ACTION UNTIL IT RECEIVES THE FINAL
REPORT OF THE COMMISSION.
REVISOR'S NOTE: This section presently appears as
Art. 1A, §8-801(d)(3).
Present references to "the joint board" are
deleted as unnecessary in light of
§5-605(a)(2) of this subtitle.
The only other changes are in style.
The Commission questions the desirability of
subsection (a)(2) of this section. Under its
provisions, an existing zoning board of
appeals may be designated as the Airport
Zoning Commission; under §5-612(b) of this
subtitle, an existing zoning board of appeals
also may be designated as the Board of
Appeals. It would appear more advisable to
vest the advisory functions of the Commission
in a separate, independent body. Accordingly,
it might be appropriate to revise subsection
(a)(2) of this section to permit only the
designation of an existing "zoning advisory
commission" as the Airport Zoning Commission.
5-609. SAME - AIRPORTS OWNED BY AND LOCATED OUTSIDE OF
POLITICAL SUBDIVISION.
(A) IN GENERAL.
IF AN AIRPORT OWNED BY A POLITICAL SUBDIVISION IS
LOCATED WHOLLY OR PARTLY OUTSIDE OF THE POLITICAL
SUBDIVISION, THE ADOPTION OF AIRPORT ZONING REGULATIONS
UNDER THIS SUBTITLE IS SUBJECT TO THIS SECTION.
