AN ACT concerning
Statute of Limitations — Election Code Violation
FOR the purpose of requiring that the prosecution of
certain election code offenses be instituted within
a certain time after the offense was committed; and
giving this Act a prospective effect.

Article - Courts and Judicial Proceedings
Section 5-106(e)
Annotated Code of Maryland
(1974 Volume and 1976 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 5-106(e) be and it is hereby
added to Article — Courts and Judicial Proceedings of
the Annotated Code of Maryland (1974 Volume and 1976
Supplement) to read as follows:
Article — Courts and Judicial Proceedings
5-106.
(E) A PROSECUTION FOR ANY MISDEMEANOR UNDER
SUBTITLES 24, 26, 30, AND 31 OF ARTICLE 33 THE ELECTION
CODE, WHICH IS NOT MADE PUNISHABLE BY CONFINEMENT IN THE
PENITENTIARY BY STATUTE, SHALL BE INSTITUTED WITHIN THREE
TWO YEARS AFTER THE MISDEMEANOR WAS COMMITTED.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall be construed only prospectively and may not be
applied or interpreted to have any effect upon or
application to any event or happening occurring prior to
the effective date of this Act.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977.
