LAWS OF MARYLAND
BY repealing and reenacting, with amendments, Article 2B - Alcoholic Beverages Section 149(b) Annotated Code of Maryland (1976 Replacement Volume and 1976 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 149(b) of Article 2B - Alcoholic
Beverages, of the Annotated Code of Maryland (1976
Replacement Volume and 1976 Supplement) be and it is
hereby repealed and reenacted, with amendments, to read
as follows: Article 2B - Alcoholic Beverages 149. (b) The Governor shall also appoint for Frederick
County, by and with the consent of the Senate and in the
event there is no resident Senator, then by and with the
consent of the members of the Frederick County delegation
to the General Assembly, an alcoholic beverages inspector
who shall perform [such] THE duties [as hereinafter]
provided BELOW. The alcoholic beverages inspector shall
serve a term of four years from May 1, 1967, and each
succeeding term shall be for four years. The salary of
the alcoholic beverages inspector [shall be $9,000] IS
$12,000 annually, and he shall receive mileage at the
rate set by the County Commissioners for other county
employees who receive mileage, but [such] mileage [shall]
DOES not include travel to and from the [said]
inspector's home and his office. The alcoholic beverages
inspector [so appointed] shall be: (1) a resident [of the
county] and a registered voter [therein] OF THE COUNTY
for more than five years immediately preceding the date
of his appointment; (2) of high moral character and
possess a sound reputation for sobriety, honesty and
integrity, and he shall devote full time to the duties of
his office. The inspector shall investigate all applicants for
an alcoholic beverage license or transfer of license in
Frederick County, enforce all alcoholic beverage laws
[therein] IN THE COUNTY; and investigate all violations
of the alcoholic beverage laws and report [the same] THEM
to the commissioner. The inspector [shall have] HAS all
the powers of a peace officer of the State of Maryland in
respect to the enforcement of the alcoholic beverage laws
of Frederick County and shall make an oath, as provided
in the Constitution of Maryland, to faithfully perform
the duties entrusted to him. The inspector shall visit
and inspect at unannounced times every licensed premises
in Frederick County at least every [ninety] 90 days. The
inspector shall make monthly reports in writing to the
license commissioner covering his activities, setting
forth any complaints, violations that may have been
