trustees: (ii) If the member has    one or more years of creditable service, OR DIES IN THE   COURSE OF THE ACTUAL PERFORMANCE OF DUTY, an amount     equal to the member's annual earnable compensation at     the time of death . SECTION 2. AND BE IT FURTHER ENACTED, That Section
195(6)(a)(ii) of Article 77 - Public Education, of the
Annotated Code of Maryland (1975 Replacement Volume and
1976 Supplement) be and it is hereby repealed and
reenacted, with amendments, to read as follows:
Article 77 - Public Education
195.
(6) (a) Upon the receipt of proper proofs of the
death of a member in service, and provided that no
benefit is payable under the provisions of § 195(8)(b) of
this article, there shall be paid to the members estate
or to the person he has nominated by written designation
duly executed and filed with the board of trustees: (ii) If the member has one or more
years of creditable service, OR DIES IN THE COURSE OF THE
ACTUAL PERFORMANCE OF DUTY, [and] AN amount equal to the
member's earnable compensation at the time of death.
SECTION 3. AND BE IT FURTHER ENACTED, That Section 53(9) of Article 88B - State Police, of the Annotated Code of Maryland (969 Replacement Volume and 1976 Supplement) be and it is hereby repealed and reenacted, with amendments, to road as follows:

53. (9) Upon the receipt of proper proofs of the death
of a member in service [who had either more than two

years of creditable service or] whose death arose out of
or in th
e course of the actual performance of duty, if in
either event the death was without wilful negligence on the part of the deceased, and upon the finding and certification by the board that the death so occurred,
there shall be paid:
(a) To the person having an incurable interest in
the life of the deceased, as nominated by the deceased's
written designation duly executed and filed with the
board of trustees, otherwise to the deceased's estate, the deceased's accumulated contributions; and
(b) To the surviving spouse, as long as the surviving spouse remains unmarried; or if there is no
surviving spouse, or if the surviving spouse dies or
