(B) PERMITTED LOCATIONS.
AN AIRPORT OR FACILITY MAY BE ESTABLISHED UNDER THIS
SECTION:
(1) BY A COUNTY, ONLY WITHIN ITS BOUNDARIES
OR THE BOUNDARIES OF ANY OTHER COUNTY WITH WHICH IT IS
ACTING JOINTLY; AND
(2) BY BALTIMORE CITY OR A MUNICIPAL
CORPORATION, EITHER WITHIN OR WITHOUT ITS BOUNDARIES.
(C) COUNTY TO ACT THROUGH ITS COMMISSIONERS OR
EXECUTIVE.
ANY ACTION BY A COUNTY UNDER THIS SECTION SHALL BE
BY ITS COUNTY COMMISSIONERS OR COUNTY EXECUTIVE, AS THE
CASE MAY BE.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 1A,
§7-701 (a) and (b).
In this section and throughout this subtitle,
the lore concise tern "political subdivision"
is substituted for unnecessary references to a
"municipality" or "county". Also, for
consistency, the defined terms "airport,
airport facility, or air navigation facility"
are substituted for references to "airports or
landing fields or other facilities for the use
of any type of aircraft".
In subsections (a) and (b) of this section,
clarifying language is added to reflect the
possibility of a political subdivision "acting
jointly" with another. This is derived from
like references appearing, e.g., in the first
sentence of present Art. 1A, §7-702 (b).
In subsection (b)(2) of this section, a
reference to "Baltimore City" is inserted to
clarify that, for purposes of this subsection,
the City is to be treated like a municipal
corporation rather than a county.
As to subsection (c) of this section, the
Commission questions whether, for chartered
counties,.. it might not be appropriate to
require authorization of the county council
rather than the county executive.
