THE ADMINISTRATION MAY WAIVE THE PROVISIONS OF THIS
SECTION REQUIRING COMPETITIVE BIDS IF:
(1) THE PURCHASE IS TO BE MADE FROM OR THE
CONTRACT IS TO BE MADE WITH THE FEDERAL OR ANY STATE
GOVERNMENT OR ANY OF THEIR AGENCIES OR POLITICAL
SUBDIVISIONS OR UNDER ANY OPEN-END BULK PURCHASE
CONTRACT OF ANY OF THEM;
(2) THE PUBLIC EXIGENCY REQUIRES THE
IMMEDIATE DELIVERY OF THE ARTICLES;
(3) ONLY ONE SOURCE OF SUPPLY IS AVAILABLE;
OR
(4) IN ITS JUDGMENT, IT IS TO THE BENEFIT OF
THE ADMINISTRATION TO USE THE SERVICES OF STATE
PURCHASING OFFICES.
REVISOR'S NOTE: This section presently appears as
Art. 1A, §§ 5-504(b) and (c).
Subsection (a) of this section is new language
added for clarity and consistency with the
basically similar provisions governing transit
facilities; see, §7—403(a) of this article.
Subsection (c)(1) of this section is added to
indicate clearly that the provisions of
subsection (c) are limited to the contracts
described in subsection (b)(1) (ii) of this
section.
In subsection (d) of this section, the words
"contracting with" are added since this
subsection might well apply to a construction
contract of $10,000 or less and, therefore, is
not limited to purchases only.
The only other changes are in style.
