Surface Mine - Other Than Coal
FOR the purpose of clarifying the utilization of funds in
the Surface Mined Land Reclamation Fund and to
provide for certain waivers from the requirements of
mining and reclamation plans.
BY repealing and reenacting, with amendments,

Section 7-6A04(a) and 7-6A19(b)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 7-6A04(a) and 7-6Al9(b) of
Article — Natural Resources, of the Annotated Code of
Maryland (1974 Replacement Volume and 1976 Supplement) be
and they are hereby repealed and reenacted, with
amendments, to read as follows:

7-6A04.
(a) All funds received by the Department from
license fees, permit fees, the forfeiture of bonds and of
cash deposits and securities, and fines collected upon
conviction of an operator under §§ 7-6A06(c) and
7-6A07(f) shall be deposited to the credit of the State
Treasurer in a bank he designates, and shall be
maintained as a special fund on the books of the
Comptroller of the treasury in an account, to be known as
the "Surface Mined Land Reclamation Fund." This Fund
shall be used by the Department for THE ADMINISTRATION
AND IMPLEMENTATION OF THIS SUBTITLE, INCLUDING
rehabilitating the area of land affected by the operation
upon which liability was charged on the bond.
7-6A19.
(b) The operator shall furnish with the mining and
reclamation plan, in a reasonable manner satisfactory to
the Department, an accurately surveyed topographic map,
in duplicate, on a scale of not smaller than one inch
equals 200 feet and with a contour interval of spacing
appropriate for the area, showing the location of the
tract of land to be affected by lining, and
representative cross—sections. The surveyed topographic
map and cross—sections shall be prepared and certified by
a registered professional engineer or registered surveyor
and snow the boundaries of the proposed affected land,
together with the drainage area above and below the area,
the location and names of all streams, roads, railroads,
and utility lines on or immediately adjacent to the area,
the outcrop line of any mineral deposit to be mined, the
