AN ACT concerning
Physicians — Registration
FOR the purpose of providing for reregistration every
third year; providing certain penalties for failure
to register; and clarifying language.
BY repealing and reenacting, with amendments,
Article 43 - Health
Section 128 and 136(b)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 128 and 136(b) of Article 43 -
Health, of the Annotated Code of Maryland (1971
Replacement Volume and 1976 Supplement) be and they are
hereby repealed and reenacted, with amendments, to read
as follows:
Article 43 - Health
128.
(a) Physicians licensed to practice medicine and
surgery in the State of Maryland shall register with the
Board. The registration shall be a permanent record of
the Board entitled "Registry of Physicians."
(b) The Registry shall be a public record and be
evidence to the same extent as are Land Records.
(c) The Board shall provide for reregistration not
less than every [second] THIRD year. The Board may
establish mandatory continuing education requirements for
physicians licensed in this State as a condition to their
being reregistered in accordance with this section. In
establishing such requirements, the Board shall recognize
and give weight to existing educational methods,
procedures, devices and programs in use among the various
medical specialities and other recognized medical groups.
The Board shall not establish or enforce such
requirements if they will reduce the availability of
physicians in a community to an extent that adequate
medical care is jeopardized.
