MARVIN MANDEL, Governor                               1427
until his successor takes office, except that the
respective terms of the sixth and seventh members first
appointed may be less than five years. (2)    [Provided, however, in] IN Carroll
County, the County Commissioners[, shall] have the
discretion to determine whether or not one of the
appointive members of the planning and zoning commission
is a member of the Board of County Commissioners[, and
provided further that the said]. THE County Commissioners
shall designate one alternate member of the commission[,]
who may be empowered to sit on the commission in the
absence of any member of the commission [; and when].
WHEN the alternate is absent, the [said] County
Commissioners [are empowered to] MAY designate a
temporary alternate who shall sit on the commission. (3)    (I) THE CHARLES COUNTY PLANNING
COMMISSION IS COMPRISED OF SEVEN SIX MEMBERS AND SHALL
REPRESENT AS MANY DIFFERENT GEOGRAPHICAL AREAS OF CHARLES
COUNTY AS IS POSSIBLE. (II)       COMPENSATION SHALL BE SET BY THE CHARLES COUNTY COMMISSIONERS. MEMBERS MAY RECEIVE SUCH COMPENSATION AS DEEMED APPROPRIATE BY THE CHARLES COUNTY
COMMISSIONERS. (III)     THE MEMBERS SERVE FOR FOUR-YEAR
TERMS OR UNTIL THEIR SUCCESSORS ARE APPOINTED AND QUALIFIED. HOWEVER, THE RESPECTIVE TERMS OF THE SEVEN MEMBERS FIRST APPOINTED SHALL BE ON A STAGGERED BASIS. HOWEVER, THE MEMBER WHO IS A MEMBER OF THE CHARLES COUNTY
COMMISSIONERS SHALL SERVE CONSISTENT WITH HIS OFFICIAL
TERM AS COMMISSIONER,. THE RESPECTIVE TERMS OF THE OTHER
MEMBERS SHALL BE ON A STAGGERED BASIS. (IV)       THE CHAIRPERSON SHALL BE APPOINTED
ANNUALLY BY THE CHARLES COUNTY COMMISSIONERS. (V)           A MEMBER OF THE CHARLES COUNTY
COMMISSIONERS MAY SIT ON THE CHARLES COUNTY PLANNING COMMISSION IN AN EX OFFICIO CAPACITY, . BUT WITH NO COMPENSATION AND WITH NO VOTING AUTHORITY THE MEMBER SHALL HAVE VOTING PRIVILEGES ON ALL MATTERS EXCEPT MATTERS ON WHICH HE WOULD BE CALLED ON TO VOTE AGAIN IN
HIS CAPACITY AS A MEMBER OF THE CHARLES COUNTY COMMISSIONERS, SUCH AS ZONING AND REZONING MATTERS. THIS MEMBER MAY NOT SHALL BE COUNTED AS ONE OF THE SEVEN SIX MEMBERS.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977.
