Preamble
WHEREAS, Among the style changes made by Chapter
344, Acts of 1976, in § 10 of Article 38A was the
substitution of the "the" for "said" in the phrase "by
registered mail to the said owner's last known
post-office address" in the second sentence. This caused
a repetition of the "the" so that the language now is "by
registered mail to the owner's last known post-office
address". The extra word ought to be deleted; now,
therefore,
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 10 of Article 38A - Fires and
Investigations, of the Annotated Code of Maryland (1971
Replacement Volume and 1976 Supplement) be and it is
hereby repealed and reenacted, with amendments, to read
as follows:
Article 38A — Fires and Investigations
10.
The written order of the State Fire Marshal made
pursuant to § 3 of this article, when directed to the
occupant of the premises, shall be served by delivering a
true copy thereof to the occupant or to any adult person
apparently in charge of the premises, within five days
from the date of issuance of [such] THE order; or, in
case the person is not found upon the premises, then by
posting a true copy thereof within five days from the
date of issuance of the order in a conspicuous place on
the door or other prominent entrance to the premises and
by mailing a copy thereof by registered mail to the
occupant at his last known post—office address, or if the
address is not known, then by registered mail to the
occupant in care of general delivery at the post office
serving the community in which the premises lie. When
directed to the owner of the premises, the order shall be
served by delivering a true copy thereof to the owner,
or, if the owner is absent from the State or his
whereabouts be unknown to the State Fire Marshal, by
mailing a true copy thereof by registered mail to the
[the] owner's last known post-office address, or, if no
[such] address [be] IS known, then by registered mail to
the owner in care of general delivery at the post office
serving the community in, which the premises lie; this
delivering or mailing of the order to be accomplished
within five days from the date of the issuance of the
order. And in the event it is necessary to mail a copy
of the order as aforesaid, the officer mailing [the same]
