LAWS OF MARYLAND
from a duly licensed motor fuel dealer, tax paid for
resale [and/]or redistribution at wholesale[.] AND WHOSE
SALES OF GASOLINE EQUAL OR EXCEED 50 PERCENT OF THE TOTAL
GALLONS OF PETROLEUM PRODUCTS PURCHASED. (4)    "Heating oil distributor"—-shall mean
and include any person, firm or corporation who buys
heating oils [and/]or kerosene for resale [and/]or
redistribution[.] AND WHOSE PRIMARY BUSINESS IS THE
RESALE OR REDISTRIBUTION OF HEATING OILS OR KEROSENE. (5)    "Sale"—-shall mean and include any
exchange, gift or other disposition, and "purchase" shall
include any acquisition of ownership. (6)    "Retail service station dealer"—shall
mean and include any person, firm or corporation
maintaining a place of business where motor vehicle fuel
is sold and delivered into the tanks of motor vehicles. (7)    "Manufacturer and     refiner"—shall mean
and include any person, firm or   corporation engaged in
producing, blending or compounding   motor vehicle fuels in
this State. (8)    "Person"—-shall mean and include
partnerships, firms, associations, companies,
corporations and shall, also, be construed to import both
the plural and singular as the case demands. (9)    "Motor fuel wholesaler"—shall mean and
include any motor fuel dealers as defined in § 135 of
Article 56 of the Annotated Code of Maryland. (10)   "PEDDLER" MEANS ANY PERSON, FIRM, OR
CORPORATION HAVING NO STORAGE FACILITY OTHER THAN TRUCKS
MHO PURCHASES KEROSENE, HEATING OIL, OR MOTOR VEHICLE
FUEL FROM A LICENSED MOTOR FUEL DEALER, JOBBER, OR
HEATING OIL DISTRIBUTOR FOR RESALE OR REDISTRIBUTION. (11)   "MAJOR BRAND" MEANS THE PRIMARY TRADE
NAME OR TRADEMARK MOST COMMONLY ASSOCIATED WITH AND
IDENTIFIED WITH A MANUFACTURER AND REFINER'S RETAIL
SERVICE STATION. (12)   "SECONDARY BRAND" MEANS A TRADE NAME OR
TRADEMARK, OTHER THAN A MAJOR BRAND, USED TO IDENTIFY A
MANUFACTURER AND REFINER'S RETAIL SERVICE STATION. (13)   "RETAIL DIESEL SELLER" MEANS A PERSON,
FIRM, OR CORPORATION MAINTAINING A RETAIL PLACE OF
BUSINESS WHERE DIESEL FUEL IS SOLD AND DELIVERED INTO THE
TANKS OF MOTOR VEHICLES. (14)   "UNBRANDED" MEANS AN INDEPENDENT RETAIL
SERVICE STATION DEALER, JOBBER, HEATING OIL DISTRIBUTOR,
MOTOR FUEL WHOLESALER, OR PEDDLER MARKETING GASOLINE OR
SPECIAL FUELS UNDER ITS OWN BRAND, TRADE NAME, OR
