REPAIR OF TRANSPORTATION FACILITIES PROJECTS AS ARE
GRANTED TO IT BY THIS TITLE OR ANY OTHER PROVISION OF
LAW.
(8) SUPERVISION OF PROJECTS.
THE AUTHORITY HAS GENERAL SUPERVISION OVER ALL
TRANSPORTATION FACILITIES PROJECTS.
(C) ESTABLISHMENT AND MAINTENANCE OF PROJECTS.
THE AUTHORITY SHALL FINANCE, CONSTRUCT, OPERATE,
REPAIR, AND MAINTAIN IN GOOD ORDER ALL TRANSPORTATION
FACILITIES PROJECTS.
REVISOR'S NOTE: This section is new language added
to express the general jurisdiction and
obligations of the Maryland Transportation
Authority over transportation facilities
projects. It is derived in part from
comparable language in present Art. 41,
§208C(b), relating to certain specified
projects. As to the disposition of present
§209(b), see General Revisor's Note to this
title. References to "supervision" and
"construction" of transportation facilities
projects are added for clarity.
The phrase "{a}cting on behalf of the
Department", which appears in present Art.
41, §208C(b) and (c), is added to express
clearly the capacity within which the
Authority acts; see, also, present Art. 41,
§208C(a) - now §4-203(b) of this subtitle.
As to the reference in subsection (a) of this
section to "any other provision of law", see,
also, Section 1 of Ch. 608, Acts of 1976.
As to the exercise of powers and duties
specified in this section, it sight be noted
that the former Toll Facilities Division of
the Authority has been administratively
upgraded to Administration status as the "Toll
Facilities Administration" of the Department.
4-205. GENERAL POWERS OF AUTHORITY.
(A) IN GENERAL.
IN ADDITION TO THE POWERS OTHERWISE SPECIFICALLY
GRANTED BY LAW, THE AUTHORITY HAS THE POWERS DESCRIBED IN
THIS SECTION.
(B) ACQUISITION AND DISPOSAL OF PROPERTY.
THE AUTHORITY MAY ACQUIRE, HOLD, AND DISPOSE OF
PROPERTY IN THE EXERCISE OF ITS POWERS AND PERFORMANCE OF
