the Courts Article. 21-903. RESERVED. 21-904. FLEEING OR ELUDING POLICE. (A)   SCOPE OF SECTION. THIS SECTION APPLIES WHEN A POLICE OFFICER GIVES A
SIGNAL TO STOP, WHETHER BY HAND, VOICE, EMERGENCY LIGHT,
OR SIREN, IF: (1)    THE POLICE OFFICER IS IN UNIFORM,
PROMINENTLY DISPLAYING HIS BADGE OR OTHER INSIGNIA OF
OFFICE; AND (2)   THE POLICE OFFICER, WHEN IN A VEHICLE, IS
IN A VEHICLE APPROPRIATELY MARKED AS A AN OFFICIAL POLICE
VEHICLE. (B)   DRIVER TO OBEY SIGNAL. IF GIVEN A VISUAL OR AUDIBLE SIGNAL BY A POLICE
OFFICES TO STOP HIS VEHICLE, THE DRIVER OF A VEHICLE MAY
NOT ATTEMPT TO ELUDE THE POLICE OFFICES, WHETHER:
(1) BY WILLFULLY FAIL FAILING TO STOP HIS
VEHICLE;
(2) FLEE BY FLEEING ON FOOT; OR
(3) OTHERWISE ATTEMPT TO ELUDE A PURSUING POLICE VEHICLE OR POLICE OFFICER, BY ANY OTHER MEANS. REVISOR'S NOTE: This section presently appears as
Art. 66 1/2, §11-904. Subsection (a) (2) of this section is revised
to clarify its applicability only if the
police officer is in a vehicle; presently, the
language of the section implies that it does
not apply at all to a police officer on foot,
an implication that apparently was not
intended. The present reference to a violation of this
section as constituting a "misdemeanor" is
deleted as unnecessary in light of §27-101 of
this article. The only other changes are in style.
