ROADWAY ONLY IN A MARKED CROSSWALK.
(D) CROSSING INTERSECTION DIAGONALLY.
A PEDESTRIAN MAY NOT CROSS A ROADWAY INTERSECTION
DIAGONALLY UNLESS AUTHORIZED BY A TRAFFIC CONTROL DEVICE
FOR CROSSING MOVEMENTS. IF AUTHORIZED TO CROSS
DIAGONALLY, A PEDESTRIAN MAY CROSS ONLY IN ACCORDANCE
WITH THE TRAFFIC CONTROL DEVICE.
REVISOR'S NOTE: This section presently appears as
Art. 66 1/2, §11-503.
In subsections (a) and (b) of this section,
the reference to an "approaching" vehicle is
added for clarity. This conforms to the
similar references in Subtitle 4 of this title
and elsewhere in the Maryland Vehicle Law
(cf., e.g., §21-705 of this title).
The only other changes are in style.
21-504. DRIVERS TO EXERCISE DUE CARE.
NOTWITHSTANDING ANY OTHER PROVISION OF THIS TITLE,
THE DRIVER OF A VEHICLE SHALL:
(1) EXERCISE DUE CARE TO AVOID COLLIDING WITH ANY
PEDESTRIAN ON ANY ROADWAY;
(2) IF NECESSARY, WARN ANY PEDESTRIAN BY SOUNDING
THE HORN OF THE VEHICLE; AND
(3) EXERCISE PROPER PRECAUTION ON OBSERVING ANY
CHILD OR ANY OBVIOUSLY CONFUSED OR INCAPACITATED

The only changes are in style.
The Commission recommends that the General
Assembly consider adopting the more recent
Uniform Vehicle Code version of this section
which, in 1971, was amended: (i) in its
counterpart to the introductory clause of this
section, to include a reference to "the
provisions of any local ordinance"; (ii) in
its counterpart to items (1) and (3) of this
section, to delete the phrase "on any
roadway"; and (iii) in its counterpart to item
(3) of this section, to refer also to an
"intoxicated" person.
