21-404. VEHICLE ENTERING HIGHWAY FROM OTHER THAN A
HIGHWAY; VEHICLE ENTERING PAVED HIGHWAY FROM UNPAVED
HIGHWAY.
(A) ENTERING HIGHWAY FROM OTHER THAN A HIGHWAY.
THE DRIVER OF A VEHICLE ABOUT TO ENTER OR CROSS A
HIGHWAY FROM A PRIVATE ROAD OR DRIVEWAY OR FROM ANY OTHER
PLACE THAT IS NOT A HIGHWAY SHALL:
(1) STOP; AND
(2) YIELD THE RIGHT-OF-WAY TO ANY OTHER
VEHICLE APPROACHING ON THE HIGHWAY.
(B) ENTERING PAVED HIGHWAY FROM UNPAVED HIGHWAY.
(1) IN THIS SUBSECTION, "PAVED HIGHWAY" MEANS
A HIGHWAY THAT HAS A HARD, SMOOTH SURFACE OF GRAVEL,
SHELLS, CRUSHED STONE, PAVING BLOCKS, ASPHALT, CONCRETE,
OR OTHER SIMILAR SUBSTANCE.
(2) THE DRIVER OF A VEHICLE ABOUT TO ENTER OR
CROSS A PAVED HIGHWAY FROM AN UNPAVED HIGHWAY SHALL:
(I) STOP; AND
(II) YIELD THE RIGHT-OF-WAY TO ANY OTHER
VEHICLE APPROACHING ON THE PAVED HIGHWAY.
REVISOR'S NOTE: This section presently appears as
Art. 66 1/2, §11-404.
In subsection (a) of this section, the phrase
"or other place...not a highway" is added to
cover situations where, for example, a vehicle
enters a highway from an open field or from
State-owned property that does not qualify as
a "private road or driveway" (see, §21—101(i)
of this title), but when the same right—of—way
rule should apply.
In subsection (b) of this section, the present
references to a paved or unpaved "public"
