Annotated Code of Maryland

(1971 Replacement Volume and 1975 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 54K be and it is hereby added
to Article 43 — Health, of the Annotated Code of Maryland
(1971 Replacement Volume and 1975 Supplement) to read as
follows:

Article 43 - Health

54K.

(A) (1) FOR THE PURPOSES OF THIS SECTION, THE
FOLLOWING WORDS HAVE THE MEANINGS INDICATED.

[[(2) "MOBILE TEST UNIT" MEANS A UNIT DEVOTED
TO PROVIDING, WITH OR WITHOUT CHARGE, A BATTERY OF TESTS
TO PERSONS TO DETERMINE THE CONDITION OF BLOOD, URINE,
TISSUE, BODILY CAVITIES, OR ANY PARTS OR THE WHOLE OF THE
HUMAN BODY, WHETHER THE ACTUAL INTERPRETATION OR READING
OF THESE TESTS TAKES PLACE WITHIN OR WITHOUT THIS
STATE;]]

(2) "MEDICAL TEST UNIT" MEANS A UNIT, MOBILE

OR OTHERWISE, OFFERING TO PROVIDE, WITH OR WITHOUT

CHARGE, ANY PHYSICAL, PHYSIOLOGICAL OR LABORATORY

EXAMINATION TO PERSONS TO DETECT ABNORMALITIES OF__BLOOD,

URINE, BODILY ORGANS OR FUNCTIONS, OR OF ANY PARTS OR THE
WHOLE OF THE HUMAN BODY WHETHER THE ACTUAL INTERPRETATION
OR READING OF THESE EXAMINATIONS TAKES PLACE WITHIN OR
WITHOUT THIS STATE.

(3) "SECRETARY" MEANS THE SECRETARY OF
HEALTH AND MENTAL HYGIENE.

(B)    THE SECRETARY, IN COOPERATION WITH THE MEDICAL
AND CHIRURGICAL FACULTY OF THIS STATE, SHALL ESTABLISH
MINIMUM STANDARDS AND QUALIFICATIONS FOR [[MOBILE]]
MEDICAL TEST UNITS OPERATING IN THE COUNTIES OF THE STATE
AND BALTIMORE CITY, TO ASSURE THE CITIZENS OF THE STATE
THAT ANY TESTS OFFERED ARE SAFE AND RELIABLE AND ARE
PROPERLY ADMINISTERED AND SUPERVISED BY QUALIFIED
PERSONNEL. IN ADDITION THE SECRETARY[[, IN COOPERATION
WITH THE MEDICAL AND CHIRURGICAL FACULTY OF THE STATE OF
MARYLAND,]] SHALL ADOPT AND PROMULGATE RULES AND
REGULATIONS FOR THIS PURPOSE.

(C)    ANY PERSON, PARTNERSHIP, ASSOCIATION, OR
CORPORATION WHO DESIRES TO OPEN OR MAINTAIN A [[MOBILE]]
