Article 77A — Higher Education

Section 9B

Annotated Code of Maryland

(1975 Replacement Volume and 1975 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 9B of Article 77A - Higher
Education, of the Annotated Code of Maryland (1975
Replacement Volume and 1975 Supplement) be and it is
hereby repealed and reenacted, with amendments, to read
as follows:

Article 77A — Higher Education

9B.

[[ (A)]]            The Board of Education of Baltimore

County shall divest on or before July 1, 1971, its
responsibility for the management and control of the
community college or colleges in Baltimore County
pursuant to § 9(a) of Article 77A of the Code[, and
pursuant to § 9(b) of said article the board of trustees
shall be appointed, except that one member of the board
shall be appointed from each councilmanic district of
Baltimore County] and pursuant to § 9(b) of said article
the board of trustees shall be appointed, except that THE
BOARD SHALL CONSIST OF NINE MEMBERS AND THAT ONE MEMBER

SHALL SERVE FROM EACH OF THE EIGHT LEGISLATIVE__DISTRICTS

IN BALTIMORE COUNTY AND ONE__MEMBER SHALL SERVE AS AN

AT-LARGE APPOINTMENT. ON JULY 1, 1976, EACH OF THE BOARD

MEMBERS CURRENTLY SERVING WILL BE REASSIGNED INTO THE

APPROPRIATE LEGISLATIVE DISTRICTS AND WILL SERVE THE

REMAINDER OF HIS OR HER PRESENT TERM. THE TWO ADDITIONAL

MEMBERS WILL BE APPOINTED INITIALLY FOR TERMS OF THREE

AND FIVE YEARS.

[[(B) NOTWITHSTANDING THE PROVISIONS OF SECTION
9(B), AS OF JULY 1, 1976, THE TERMS OF THE CURRENT
MEMBERS OF THE BOARD ARE TERMINATED. THEREAFTER, THE
BOARD CONSISTS OF NINE MEMBERS. EIGHT OF THE MEMBERS
SHALL BE APPOINTED FROM EACH OF THE LEGISLATIVE DISTRICTS
LYING WHOLLY OR IN PART IN BALTIMORE COUNTY. THE
REMAINING MEMBER SHALL BE APPOINTED AT-LARGE.
APPOINTMENTS AND REAPPOINTMENTS SHALL BE AS IS SET FORTH
IN SECTION 9 (B) OF THIS ARTICLE.]]

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
