Section 3—413

Annotated Code of Maryland

(1974 Volume and 1975 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 3-413 be and it is hereby
added to Article — Courts and Judicial Proceedings, of
the Annotated Code of Maryland (1974 Volume and 1975
Supplement) to read as follows:

Article — Courts and Judicial Proceedings

3-413.

THE PROVISIONS OF THIS SUBTITLE, EXCEPT THE
PROVISIONS OF §§ 3-403(A), 3-406, AND 3-411,         ARE

SEVERABLE.        THE FINDING BY A COURT THAT A SEVERABLE

PROVISION OF THIS SUBTITLE IS INVALID DOES NOT AFFECT THE
VALIDITY OR OPERATION OF THE OTHER PROVISIONS OF THIS
SUBTITLE , UNLESS THE COURT FINDS THAT THE LONE REMAINING
VALID PROVISIONS ARE INCOMPLETE AND INCAPABLE OF BEING
EXECUTED IN ACCORDANCE WITH THE LEGISLATIVE INTENT.

REVISOR'S NOTE: Ch. 691, Acts of 1974, erroneously
repealed former CJ § 3—413 in reliance on
Article 1, § 23 of the Code. The latter
establishes a general severability clause for
all statutes enacted after July 1, 1973, but
not, however, if the statute "specifically
provides that its provisions are not
severable. "

CJ § 3—413, as well as its source law
(former Article 31A, § 14), specifically
provided that certain of the provisions of the
Declaratory Judgments Act are not intended to
be severable. Consequently, § 3—413 should
not have been repealed; by this Act it is
readopted as originally drafted, with but
minor stylistic changes made for clarity.

SECTION 2. AND BE IT FURTHER ENACTED, That the

Revisor's Note contained in this Act is not law and may
not be considered to have been enacted as a part of this
Act.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
