(E)          "HOME HEALTH CARE SERVICES" MEANS A BROAD
RANGE OF SERVICES [[FROM NURSING,]] , AS DEFINED IN
SUB-SECTION (B) ABOVE, UNDER PHYSICIAN DIRECTION, [[TO A
COORDINATED HOME CARE PROGRAM]] WHICH IS CENTRALLY
ADMINISTERED.

(F)          "PATIENT" MEANS ONE WHOSE HEALTH CARE NEEDS
CAN BE MET ADEQUATELY BY THE PROVISION OF HOME HEALTH
SERVICES ON A PART-TIME OR INTERMITTENT BASIS.

872.

THE DEPARTMENT SHALL DEVELOP, INITIATE, AND
IMPLEMENT RULES AND REGULATIONS CONTAINING STANDARDS FOR
THE CARE, TREATMENT, HEALTH, SAFETY, WELFARE, AND COMFORT
OF PATIENTS SERVED BY HOME HEALTH AGENCIES WHICH WILL
PROMOTE SAFE AND ADEQUATE CARE AND TREATMENT OF THE
PATIENTS. FURTHER, THE DEPARTMENT SHALL PROMULGATE RULES
AND REGULATIONS RELATING TO THE LICENSURE OF HOME HEALTH
AGENCIES. THE REQUIREMENTS FOR CERTIFICATION OF
CONFORMANCE TO THE AREA AND STATE HEALTH PLANS RELATING

TO LICENSURE OF SECTION 559 (A-1) OF THIS CODE SHALL

APPLY TO HOME HEALTH AGENCIES.

873.

THE DEPARTMENT SHALL MAKE INSPECTIONS OF THE
OPERATIONS OF HOME HEALTH AGENCIES AND ISSUE, DENY OR
REVOKE ANNUAL LICENSES IN ACCORDANCE WITH ITS RULES AND
REGULATIONS ADOPTED UNDER THIS SUBTITLE.

874.

THE RULES AND REGULATIONS SHALL INCLUDE, WHEN
APPROPRIATE, BUT ARE NOT LIMITED TO

(A)    THE ESTABLISHMENT OF HOME HEALTH AGENCIES;

(B)    PROVISIONS REQUIRING THE HOME HEALTH AGENCY TO
HAVE POLICIES ESTABLISHED BY A PROFESSIONAL GROUP;

(C)    PROVISIONS GOVERNING THE SERVICE PROVIDED BY
THE HOME HEALTH AGENCIES;

(D)    PROVISIONS FOR THE SUPERVISION OF SERVICES BY
A PHYSICIAN HOLDING AN UNLIMITED LICENSE TO PRACTICE
MEDICINE, SURGERY, AND OBSTETRICS IN MARYLAND OR A
REGISTERED PROFESSIONAL NURSE, AS APPROPRIATE;

(E)    PROVISIONS REGARDING THE MAINTENANCE OF
CLINICAL RECORDS OF ALL PATIENTS, INCLUDING, BUT NOT
LIMITED TO, A PLAN OF TREATMENT TO BE PROVIDED.

875.

[[TO OBTAIN VALID LICENSURE, THE HOME HEALTH AGENCY
SHALL PROVIDE APPROPRIATE HOME HEALTH SERVICES, UNDER THE
DIRECTION AND GUIDANCE OF A LICENSED PHYSICIAN, TO ALL
