AN ACT concerning
Public Defender — Reimbursement
FOR the purpose of requiring a defendant to reimburse the
Public Defender for services rendered if he is
ordered to do so by a court as a term or condition
of any sentence , judgment, or stay of judgment
imposed; specifying a guideline for the court as to
imposition of such a condition; and providing for
the establishment of the amount, time, and method of
payment of reimbursement.

(1971 Replacement Volume and 1975 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 7(g) be and it is hereby added
to Article 27A — Public Defender, of the Annotated Code
of Maryland (1971 Replacement Volume and 1975 Supplement)
to read as follows:

(G) A COURT EXERCISING CRIMINAL JURISDICTION MAY
ORDER A DEFENDANT TO REIMBURSE THE STATE FOR SERVICES
RENDERED TO THE DEFENDANT BY THE PUBLIC DEFENDER AS A
TERM OR CONDITION OF ANY SENTENCE [[OR]], JUDGMENT , OR
STAY OF JUDGMENT ENTERED UNDER SECTION 641(A) OR SECTION
292 OF ARTICLE 27 OF THE CODE IMPOSED BY IT IF THE COURT
FINDS THAT THE DEFENDANT HAS THE ABILITY TO MAKE SUCH
REIMBURSEMENT. THE AMOUNT, TIME, AND METHOD OF PAYMENT
SHALL BE ESTABLISHED BY THE COURT. IN ALL OTHER CASES OF
REIMBURSEMENT FOR SERVICES RENDERED, COLLECTION SHALL BE
MADE IN ACCORDANCE WITH SUBSECTION (F).
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
