EXECUTIVE ORDERS
Maryland already provides that all meetings of the
Executive agencies of State Government shall be open
to the public; and
WHEREAS, Although that section of the Code does not
prevent any such agency from having executive
sessions, neither does it or any other part of the
Code specifically authorize or require such
sessions; and
WHEREAS, Article 41, Section 15 of the Code provides that
the Governor shall have supervision and direction
over the officers and agencies assigned to the
Executive Department;
NOW, THEREFORE, I, MARVIN MANDEL, GOVERNOR OF MARYLAND,
PURSUANT TO THE AUTHORITY VESTED IN ME BY ARTICLE
II, SECTION 1 OF THE CONSTITUTION OF MARYLAND AND BY
ARTICLE 41, SECTION 15 OF THE ANNOTATED CODE OF
MARYLAND, HEREBY ISSUE THE FOLLOWING EXECUTIVE
ORDER:
1. Definitions:
(a) As used in this Executive Order, the following
terms have the meanings indicated.
(b) "Advisory function" means the rendering of
advice or recommendations to an executive
public body or an official of the Executive
Department, and the study or evaluation of
public issues, policies, and matters
preparatory to the rendering of such advice or
recommendations, pursuant to a lawful
delegation of that responsibility by the
executive public body or official.
(c) "Executive function" means the administration
or application of the laws of Maryland or the
rules, regulations, or by-laws of the
executive public body.
(d) "Executive public body" means an entity
consisting of two or more persons that:
(1) is created by or pursuant to statute
enacted by the General Assembly, or by
Executive Order of the Governor; and
(2) is assigned to the Executive Department
of the State Government.
The term "executive public body" does not
include the Governor's Executive Council
