Dear Mr. Speaker:
In accordance with Article II, Section 17 of the
Maryland Constitution, I have today vetoed House Bill
143.
This bill amends Section 12F-3 of Article 81 to
authorize the counties and Baltimore City to grant a
local real property tax credit to certain homeowners who
receive permanent and total disability benefits under any
federal, State, or other public agency retirement system.
Present Section 12F—3 authorizes the credit only for
those receiving such benefits under the Social Security
Act or the Railroad Retirement Act.
House Bill 1898, which was enacted by the General
Assembly and signed by me on May 17, 1976, provides most
of the relief provided for in House Bill 143 by expanding
the existing "circuit breaker" credit to these disabled
persons and repealing the various local credits, except
on a "save harmless" basis. This expansion of the
circuit breaker program includes the repeal of Section
12F-3 of Article 81.
Because of the inconsistency between these two bills
with respect to Section 12F-3, and because House Bill
1898 is a comprehensive treatment of the program of
property tax relief for the elderly and the disabled, I
have decided to veto House Bill 143.
