Montgomery and Prince George's Counties to represent any
indigent petitioner who seeks to enforce a duty of child
support under the provisions of the Uniform Reciprocal
Enforcement of Support Act (Article 89C of the Code).
House Bill 1478, which was enacted by the General
Assembly and signed by me on May 17, 1976, provides for
the enforcement and recovery of child support payments in
certain cases by establishing a Division of Child Support
Enforcement within the State's Social Services
Administration. The Division will implement a program to
recover child support payments from absent parents of
children who receive aid to families with dependent
children.
House Bill 1478 amends Article 89C to provide that
the State's Attorney of a County or Baltimore City shall
represent a obligee (petitioner) , unless the newly
created Division of Child Support Enforcement has become
a party to the enforcement action by virtue of the
provisions of the law which creates it. In such cases,
the Division is represented by the Attorney General or by
an attorney of the Social Services Administration
appointed to represent the Division, or by the State's
Attorney under certain circumstances. In any event, a
parent (obligee) in any jurisdiction who seeks to enforce
a duty of child support is represented in all cases in
which the newly created Division of Child Support
Enforcement is involved and in all cases involving
Article 89C. Representation is provided regardless of
the economic status of the parent.
Since the purpose of Senate Bill 964 is accomplished
by the enactment and signing of House Bill 1478, it is
unnecessary for me to sign Senate Bill 964.
