that School Board District III will include Election
District 17 in its entirety and at the same time provides
that the specially described area is to be included in
School Board District II, part of that specially
described area will have been placed in two school board
districts.

The remainder and largest portion of the specially
described area consists principally of all or part of
precincts 1 through 5 of Election District 16 and
apparently** includes a small portion of precinct 3 of
Election District 2. Precincts 1 and 2 of Election
District 16 are purportedly included in School Board
District IV as a consequence of paragraph (iv), whereas
precincts 3, 4 and 5 of Election District 16 are
explicitly included within School Board District II
pursuant to paragraph (ii).*** While there is thus an
inconsistency with respect to precincts 1 and 2,
precincts 3, 4 and 5 are included in School Board
District II as a consequence of both the specific
reference to those precincts and their inclusion within
the specially described area.

We are attaching a map provided to us by the State
Administrative Board of Election Laws which indicates the
boundary lines of the areas and districts involved.

While, as we have indicated, Senate Bill 863 leaves
a number of inconsistencies and inaccuracies relative to
the school board district lines, it is undeniably true
that the present law is likewise inaccurate and incorrect
in its description of the boundary lines. The one
respect in which Senate Bill 863 can be said to compound
the problem is with respect to the relatively small
portion of the specially described area which is in fact a
part of Election District 17. As a consequence of the
change made to paragraph (iii) beginning at line 129 of
the Bill, that small area would be included in both
School Board District II and School Board District III.
Otherwise Senate Bill 863 does not compound the problems
discussed above.****

We should note that this letter is based on
information furnished to us by the State Administrative
Board of Election Laws. We have no independent and
direct knowledge of the precise boundaries of the areas
in question.
