the department to be acting commissioner. In case of the
absence or incapacitating disability of the Police
Commissioner without his having designated an acting
commissioner, the next ranking member of the department,
as may be determined by Order promulgated by the Police
Commissioner in accordance with the authority vested in
him by this subtitle, shall be acting police commissioner
while [such] THE absence or disability continues. In no
case shall the appointment of an acting police
commissioner continue for a period longer than [ninety
(90) ] 90 days unless approval [therefore] is expressly
given by the [Governor] MAYOR, nor in any event shall
[such] THE appointment continue beyond the term for which
the Police Commissioner was appointed. Should the
[Governor] MAYOR withhold [such] THE approval, he shall
[forthwith] designate an acting police commissioner to
serve at his pleasure until the Police Commissioner
reassumes the duties and responsibilities of his office,
but in no event shall [such] THE appointment continue
beyond the term for which the Police Commissioner was
appointed. An acting police commissioner appointed under
the provisions of this section shall have, during the
time in which he acts as police commissioner, all the
powers and duties conferred by law upon the Police
Commissioner. An acting police commissioner appointed
from within the department shall receive no extra
compensation for his services [as such]. An acting
police commissioner appointed by the [Governor] MAYOR,
who is not a member of the department, shall receive a
salary during his service which shall not be less in
amount than that then authorized for payment to the
Commissioner.

[Said] THE Commissioner shall make an annual report
[to the Governor and] to the Mayor and City Council of
Baltimore, covering and reporting upon the operations and
work of the Department in [such] detail as [shall] TO
enable the [Governor and] Mayor and City Council of
Baltimore to maintain a continuing familiarity with the
program and operations of the Department. [Said] THE
Commissioner shall also make [such] special reports[,]
and provide [such] specific information[, ] as may be
required from time to time by [the Governor or by] the
Mayor for normal administrative, financial and managerial
purposes.

SECTION 2. AND BE IT FURTHER ENACTED, That Section 1
of this Act does not alter or affect the term of the
incumbent in the office of Police Commissioner of
Baltimore City on the effective date of this Act. When
Section 1 goes into effect and becomes operative, the
Mayor of Baltimore City may not appoint a Police
Commissioner until the expiration of the term of the
incumbent in office on the effective date of this Act, or
until the office becomes vacant by reason of death,
