CHAPTER 916

(Senate Bill 542)

AN ACT concerning

Carroll and Frederick Counties - Utility Work

FOR the purpose of requiring certain regulations to state
that certain utility work in Carroll and Frederick
Counties shall be performed only by a licensed
utility contractor or a registered master plumber;
and clarifying language.

BY repealing and reenacting, with amendments,

Article 43 - Health

Section 325C

Annotated Code of Maryland

(1971 Replacement Volume and 1975 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 325C of Article 43 - Health, of
the Annotated Code of Maryland (197 1 Replacement Volume
and 1975 Supplement) be and it is hereby repealed and
reenacted, with amendments, to read as follows:

Article 43 - Health

325C.

(A) The Secretary of the Department of Licensing
and Regulation shall on or before January 1, 1972,
promulgate up—to—date plumbing regulations based on the
principles of environmental sanitation and safety through
properly designed, acceptably installed, and adequately
maintained plumbing systems. The political subdivisions
may enact and enforce plumbing regulations which meet or
exceed the minimum standards promulgated by the Secretary
and if the subdivisions do not enact and enforce these
regulations the State Board of Commissioners of Practical
Plumbing shall enforce the State regulations. [Said] THE
Board shall have the power to amend with the approval of
the Secretary [said] THESE regulations from time to time
as the need arises.

(3) FOR CARROLL AND FREDERICK COUNTIES, THE
REGULATIONS SHALL REQUIRE THAT ALL UTILITY WORK, MEANING
THE INSTALLATION OF WATER LINES, SANITARY SEWERS, STORM
DRAINAGE AND RELATED APPURTENANCES, DONE FROM THE
PROPERTY LINE OF ANY PROPERTY TO A POINT NOT
[[EXCEEDING]] LESS THAN FIVE FEET FROM THE FOUNDATION
WALL OF ANY BUILDING OF STRUCTURE ON THE PROPERTY SHALL
BE PERFORMED ONLY UNDER A VALID PERMIT AND BY A UTILITY
CONTRACTOR WHO IS LICENSED UNDER THE PROVISIONS OF
SECTION 180 OF ARTICLE 56 OF THIS CODE OR BY A REGISTERED
