FOR the purpose of providing that licensed dentists and
licensed dental hygienists may practice dentistry
and dental hygiene, respectively, as employees of a
certified Health Maintenance Organization; and
clarifying language.

BY repealing and reenacting, with amendments,

Article 32 — Dentistry

Section 1 and 31(b)

Annotated Code of Maryland

(1971 Replacement Volume and 1975 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF

MARYLAND, That Sections 1 and 31 (b) of Article 32 -
Dentistry, of the Annotated Code of Maryland (1971
Replacement Volume and 1975 Supplement) be and they are
hereby repealed and reenacted, with amendments, to read
as follows:

Article 32 — Dentistry

1.

It shall be unlawful for any person to engage in the
practice of dentistry in the State of Maryland, unless
such person shall have obtained a license from the State
Board of Dental Examiners of the State of Maryland as
hereinafter provided, except that the license of any
dentist, existing on June 1, 1959, shall continue in
force unless suspended or revoked by the Board in the
manner hereinafter provided.

All licenses issued by the Board shall be issued to
individual persons, and it shall be unlawful for any
dentist to practice in this State under any name except
his own true name. No license shall be issued to any
corporation, association, partnership, parlor, or any
entity or association of any kind or character. It shall
be unlawful for any individual or group of individuals
to practice dentistry in this State as a corporation or
under a corporate name; or under a partnership name; as
an association or under an association name; as a parlor
or under any parlor name, or an entity or under the name
of any entity of any kind or character. HOWEVER, A
PERSON LICENSED UNDER THESE PROVISIONS MAY PRACTICE
DENTISTRY UNDER HIS OWN NAME AS AN EMPLOYEE OF A HEALTH
MAINTENANCE ORGANIZATION, WHICH PROVIDES DENTAL SERVICES
TO MEMBERS OF THE ORGANIZATION, PROVIDED THE ORGANIZATION
IS CERTIFIED BY THE STATE INSURANCE COMMISSIONER UNDER
ARTICLE 43, SECTION 843 OF THIS CODE.

(b) Any person licensed to practice dental hygiene
