25 or more bedrooms located under one roof regularly
serving meals or any restaurant seating at least 50
persons and which restaurant can show that at least
[sixty] 60 percent of the gross income is derived from
the sale of food, notwithstanding the other requirements
of this article, and otherwise complying with the
provisions of this article upon the payment of an annual
license fee of [$1,000.00] $1,000 shall be entitled to
serve liquors, wines and beers between the hours of 7
a.m. and 1 a.m. (Eastern Standard Time), on the day
following, except on Sunday when [no] ANY sales [shall]
MAY NOT be allowed. [No] ANY sale of liquor as provided
[herein shall] FOR MAY NOT exceed one quart and [no] ANY
sales [shall] MAY NOT be made at bars or counters. This
license for a restaurant does not cover "package sales"
or any other form of "off—sale" [of] alcoholic beverages.

[(1)] (W) In Washington County the annual
fee for [such a] THIS license [shall be five hundred
dollars ($500.00) ] IS $500.

[(1—1)] (X) (1) In Wicomico County the annual fee
for [such a] THIS license [shall be one thousand dollars
($1,000)] IS $1,000 for a restaurant and [fifteen hundred
dollars ($1,500)] $1,500 for a hotel.

(2)    [Such a] THIS license may be issued in
Wicomico County to a bona fide hotel which (i) is an
establishment for the accommodation of the public
providing services ordinarily found in hotels, (ii) is
equipped with not fewer than [twenty—five] 25 rooms, a
lobby with registration and mail desk and seating
facilities and a dining room which serves full—course
meals at least twice daily. This license in a hotel does
not permit sales for consumption off the premises.

(3)    [Such a] THIS license may be issued in
Wicomico County to a restaurant which meets the following
requirements and conditions: (i) is a business
establishment for the accommodation of the public, fully
equipped with a proper and adequate dining room, tables,
chairs, and sufficient facilities for preparing and
serving full—course regular meals at least twice daily,
[wherein] WHERE the patron is offered a general choice of
several varied types of food for a main course and
supplemental extra foods; (ii) has a regular seating
capacity at tables (not including seats at bars or
counters) for [seventy-five] 75 or more persons seated
comfortably and adequately; (iii) serves alcoholic
beverages only during or in connection with meals, with
patrons seated at tables or at bars or counters; (iv)
during the effective period of the license has daily
average receipts from the sale of food in excess of those
for the sale of alcoholic beverages; (v) has an applicant
or applicants for the license who has or have been a bona
fide resident or residents of Wicomico County for not
less than five years immediately preceding the filing of
the application, and who has or have been a registered
