acquired by it in THE county, plus an amount equal to the
Commission's fixed obligations under contracts the first
six months of the county's fiscal year, plus the amounts
credited to the Commission's self—insurance fund, plus
the sum of $200,000 with respect to Montgomery County and
$150,000 with respect to Prince George's County. The
difference between the two totals [shall be] IS the net
unexpended balance of the Commission which the county may
credit[, as hereinafter provided,] against the amounts
payable by that county to the Commission in the next
succeeding fiscal year, pursuant to provisions elsewhere
in this title.
7-102.
The area in Montgomery and Prince George's
counties[, Maryland,] within the boundaries specified
[hereinbelow] in this title is continued under a
corporate agency for the purposes set forth in this
[subheading] TITLE and elsewhere in this [subtitle]
[[TITLE]] ARTICLE. It is the same district and corporate
agency as was created by Chapter 714 of the Acts of the
General Assembly of Maryland of 1939 and continued by
Chapter 992 of the Acts of the General Assembly of
Maryland of 1943, and Chapter 780 of the Acts of the
General Assembly of Maryland of 19 59. It shall be known
as the Maryland—Washington Regional District, and
hereafter in this [subtitle] TITLE it may be referred to
as the "regional district" or as "district."
7-103.
(a) The entire area of Montgomery County is within
the regional district, subject to the provisions of
[Title] SECTION 7-105.
7-106.
(a) The Commission may include in its annual
budget provision for the acquisition of lands[,] needed
for [arterial limited access] ANY STATE highways,
STREETS, OR ROADS and for school sites and other public
uses[, except streets or roads (other than such arterial
limited access highways),] in Montgomery County. The
[arterial limited access] highway, STREET, ROAD, school
site, or other public use [must] SHALL be shown upon the
Commission's general plan for the physical development of
the regional district OR AN ADOPTED PLAN and each such
acquisition shall have received the approval by formal
resolution of the district council of Montgomery County.
[The arterial limited access highway or]A school site or
other public use, OTHER THAN A STATE HIGHWAY, STREET, OF
ROAD, may not be within [the road construction program or
other] A public construction program current at the time
of acquisition. [No] A school site may NOT be acquired
under the terms of this section without the prior
approval of the Montgomery County Board of Education.
