Article 11 - Public Local Laws of Maryland
(1959 Edition and 1972 Supplement, as amended)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 40-9 of the Public Local Laws of
Frederick County being Article 11 of the Public Local
Laws of Maryland (1959 Edition and 1972 Supplement, as
amended) be and it is hereby repealed and reenacted, with
amendments, to read as follows:

Article 11

40-8.

(A)    Except for compliance with setback lines
required [herein] IN THIS, section 40—67, and the mobile
home provisions in section 10—66(a), [nothing in] this
chapter [shall] DOES NOT prohibit the use of any land for
agricultural purposes or the construction or use of
buildings or structures incident to the use of
agricultural purposes of the land on which [such] THE
buildings or structures are located.

(B)    IN ALL CONSERVATION AND AGRICULTURE ZONING,
THE PREFERRED USE IS AGRICULTURE. THE OPERATION AT ANY
TIME OF ANY MACHINERY USED IN FARMING PROCEDURES AND ALL
OTHER AGRICULTURAL OPERATIONS SHALL BE PERMITTED AND HAVE
PREFERENCE OVER ALL OTHER USES.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
