requiring that [such] action be taken as [it] HE deems
necessary to meet the emergency. [Such] THE order shall
be effective immediately.
685.
The powers, duties and functions vested in the
[Maryland State Board of Health] SECRETARY under the
provisions of this subtitle shall not be construed to
affect in any manner the powers, duties and functions
vested in the [Maryland State Board of Health] SECRETARY
under any other provisions of law.
687.
Any person failing, refusing or neglecting to comply
with the provisions of this subtitle or with any rule or
regulation made by the [Maryland State Board of Health]
SECRETARY under the powers conferred by this subtitle
[shall be] IS guilty of a misdemeanor, and upon
conviction shall be fined not more than [one hundred
dollars ($100) ] $100 for each day that a violation
continues provided that a written notice of any violation
shall be served on some person in charge of the place
where [such] THE violation exists prior to any
prosecution for violation of any provision of this
subtitle or any rules or regulations promulgated
thereunder.
689A.
(a) The [Board] SECRETARY shall promulgate
regulations for general or specific licensing of ionizing
radiation sources and by-products, special nuclear
materials, or devices or equipment utilizing such
materials. Such regulations shall provide for amendment,
suspension or revocation of licenses.
(b) The [Board] SECRETARY shall require
registration or licensing of other sources of ionizing
radiation.
(c) The [Board] SECRETARY is authorized to exempt
certain sources of ionizing radiation or kinds of uses or
users from the licensing or registration requirements set
forth in this section when the [Board] SECRETARY makes a
finding that the exemption of such sources of ionizing
radiation or kinds of uses or users will not constitute a
significant risk to the health and safety of the public.
(d) Regulations promulgated pursuant to this
section may provide for recognition of other State or
federal licenses as the [Board] SECRETARY may deem
desirable, subject to [such] registration requirements as
the [Board] SECRETARY may prescribe.
(e) The [Commissioner of Health] SECRETARY is
authorized in the event of an emergency to impound or
