Secretary of Health and Mental Hygiene, AND SHALL SERVE
AT THE PLEASURE OF THE SECRETARY. [He] [[THE COMMISSIONER
SHALL HAVE THE MINIMUM QUALIFICATIONS OF A BACCALAUREATE
DEGREE AND EXPERIENCE IN HEALTH ADMINISTRATION AND SHALL
BE QUALIFIED IN THE FUNCTIONS AND PROGRAMS ADMINISTERED
BY THE ADMINISTRATION. ]] THE [[COMMISSIONER]] DIRECTOR
shall receive such salary as may be provided in the
budget. [He shall serve until removed by the Governor
upon the recommendation of the Secretary.] THE DIRECTOR
SHALL REPORT TO THE ASSISTANT SECRETARY FOR MENTAL HEALTH

AND ADDICTIONS AND IS RESPONSIBLE FOR CARRYING OUT THE

POWERS, DUTIES, RESPONSIBILITIES, AND FUNCTIONS OF THE
ADMINISTRATION.

8.

The [[Commissioner]] DIRECTOR shall have the
following powers and duties:

(c) He shall appoint, subject to the approval of
the Secretary, [a deputy commissioner of mental hygiene,]
such assistant [[commissioners]] DIRECTORS as may be
provided for in the budget. [The deputy Commissioner
shall serve at the pleasure of the Secretary.] The
assistant [[commissioners]] DIRECTORS and the
superintendents shall be subject to removal by the
[[Commissioner]] DIRECTOR for incompetance or misconduct.

SECTION 9. AND BE IT FURTHER ENACTED, That new
Section 9 be and it is hereby added to Article 59 —
Mental Hygiene, of the Annotated Code of Maryland (1972
Replacement Volume and 1975 Supplement) to read as
follows:

Article 59 — Mental Hygiene

9.

(A)    THERE IS AN ADVISORY COUNCIL ON MENTAL HYGIENE
IN THE MENTAL HYGIENE ADMINISTRATION.

(B)    (1) THE GOVERNOR SHALL APPOINT THE MEMBERS
OF THE COUNCIL.

(2) IT IS THE INTENTION OF THE GENERAL
ASSEMBLY THAT THE COUNCIL BE REPRESENTATIVE OF THE
INTERESTS OF PUBLIC AND PRIVATE AGENCIES AND GROUPS
DIRECTLY AND INDIRECTLY CONCERNED WITH MENTAL HYGIENE,
INCLUDING PREVENTION, TREATMENT, AND REHABILITATION AND
THAT THE COUNCIL COLLECTIVELY SHALL BE A STRONG ADVOCATE
IN ENSURING A COMPREHENSIVE, BROAD-BASED APPROACH TO THE
SOCIAL, ECONOMIC, AND MEDICAL PROBLEMS OF MENTAL HYGIENE.
THEREFORE, THE COUNCIL SHALL INCLUDE REPRESENTATIVES FROM
A BROAD RANGE OF AGENCIES AND INTERESTS, SUCH AS THE
COURTS, POLICE, PROBATION OFFICES, CLERGY, LABOR,
MANAGEMENT, LEGAL AND MEDICAL PROFESSIONS, MENTAL HEALTH
ASSOCIATIONS, AND OTHER GROUPS TO BE SERVED SUCH AS STATE
AND LOCAL GOVERNMENTS AND PRIVATE EMPLOYEE GROUPS, LOCAL
