Mentally Retarded Persons' Rights

FOR the purpose of providing that a mentally retarded
person has the right to possession and use of his
clothing and personal effects; providing that a
certain person may take temporary custody of the
clothing and personal effects for certain reasons;
requiring a certain notation in a resident's record;
and clarifying language.

BY repealing and reenacting, with amendments,

Article 59A - Mental Retardation

Section 34(a) (2)

Annotated Code of Maryland

(1972 Replacement Volume and 1975 Supplement)

BY adding to

Article 59A - Mental Retardation

Section 34 (a) (4)

Annotated Code of Maryland

(1972 Replacement Volume and 1975 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 34(a) (2) of Article 59A - Mental
Retardation, of the Annotated Code of Maryland (1972
Replacement Volume and 1975 Supplement) be and it is
hereby repealed and reenacted, with amendments, to read
as follows:

Article 59A — Mental Retardation

34.

(a) Every mentally retarded person in any facility
licensed by or under the jurisdiction of the
Administration shall at all reasonable times:

(2) Have REASONABLE access to telephones [and shall
be permitted to telephone any person who has advised the
facility, in writing, of his willingness to receive such
telephone communications].

SECTION 2. AND BE IT FURTHER ENACTED, That new
Section 34 (a) (4) be and it is hereby added to Article 59A
- Mental Retardation, of the Annotated Code of Maryland
(1972 Replacement Volume and 1975 Supplement) to read as
follows:
